Owing the Government

If you owe tax arrears, the government does not have to sue you. They simply file a tax levy which is the same as a judgment against you. Sometimes, you can simply obtain debt relief through a government tax workout plan. This is a good option if the debt is small. For larger amounts, bankruptcy may be a better option.

The Bankruptcy Alternative

In a Chapter 7 bankruptcy, you simply discharge the taxes along with your other debt if your tax arrears are more than three years old. If the tax debt is more recent, you may file for a Chapter 13 instead. With a Chapter 13, you can establish a payment plan that is within your current budget and deal with the remainder of your debt as well.
